Wills

It is always recommended that you have a Will prepared by an attorney to plan for the disposition of your assets in the event of your death.   We can meet with you to plan and draft a Will that best meets your wishes and desires.   When drafting a Will, it is important that you understand the legal process involved when a person dies, and how the property is transferred according to your wishes.  We will meet with you to discuss your situation, and draft a legal document to ensure that your wishes are honored by the Courts.   At your appointment, we will also discuss other estate planning documents that you might want to consider, such as a medical power of attorney and a physician’s directive (also known as a living will).

Probate

When a person dies, there is legal procedure involved which is set up to allow a representative to handle their estate.  This process is known as “Probate.”  The process differs depending upon whether or not the deceased person left a valid Will, or died without a Will.   If you have an interest in the estate of a deceased person, attorneys at our firm are experienced in probate matters, and will meet with you to discuss the best manner to proceed to ensure that your legal rights are protected.  Furthermore, if you are named in a decedent’s Will as the Executor or Executrix of an estate, Mr. Hervol can represent you in probate court in connection with carrying our your duties imposed by the Will and the Texas Probate Code.   Please contact our office for a consultation.
